Resumen

El presente estudio tiene como objetivo analizar el problema de la protección de grupos particularmente vulnerables, como es el caso de los niños y jóvenes en la sociedad de la información, y reflexionar sobre las medidas que deben ser adoptadas para combatir los peligros y las amenazas a que están sujetos los menores en la sociedad digital. Los objetivos específicos consisten en recapitular lo que se ha hecho en materia de protección de los menores en el mundo digital y enunciar los próximos pasos necesarios para reforzarla.
Se utilizan metodologías que hacen una aproximación teórica y descriptiva a través del estudio de los programas europeos que permiten la convergencia de las tecnologías de información, del audiovisual y de las comunicaciones, así como, se hace el análisis de legislación, sobre protección de los menores en los servicios audiovisuales y de información. Las metodologías empíricas utilizadas se basan en estudios realizados en niños de edades comprendidas entre los 8 y los 16 años de edad, que revelan que los niños, no sólo están adictos a comunicarse a través de las redes sociales, sino que también tienen comportamientos muy peligrosos en ellos, poniéndolos a ellos mismos y al resto de la familia en peligro, y que cerca del 31% estan dispuestas a mentir en línea sobre su edad. La mayoría de los menores acaba por compartir «mucha información personal», sin darse cuenta de que la información que comparten puede ser vista y utilizada por personas peligrosas. Cerca del 66% comparte el nombre de la escuela que frecuentan, el 54% comparte los sitios que visitan y el 22% exponen sus domicilios. Diversos informes de la Comisión Europea presentan las medidas adoptadas por los Estados miembros para proteger a los niños en el contexto de las actividades en línea, como el programa «Internet Programme» de la Comisión Europea sobre un uso más seguro de Internet, pero no es suficiente porque los niños siguen logrando acceder sin grandes dificultades a un contenido que no son adecuados para su edad, que son ilegales y perjudiciales.
Los resultados obtenidos demuestran que las restricciones de edad en Internet son ineficaces ante los contenidos ilegales o perjudiciales en la Web y tienen como consecuencia el uso clandestino de muchos servicios en línea.
En conclusión,  los padres y los educadores no están consiguiendo acompañar los cambios provocados en los menores por las innovaciones tecnológicas. Se hace urgente reflejar sobre la necesidad de invertir en la educación de los más jóvenes, enseñándoles a lidiar con el mundo digital, y en la apuesta por combatir el contenido ilícito. La concreción de estas medidas pasa por la intervención de los responsables de la elaboración de las leyes, a nivel internacional y nacional, pero también deben utilizarse medios tecnológicos de control y filtrado de la información. Además, los contenidos ilegales o perjudiciales proceden de otros Estados miembros de la UE o de terceros países. Un enfoque coordinado a escala europea y, a continuación, internacional, permitiría armonizar la protección contra este tipo de contenidos.

Abstract

The purpose of this study is to analyze the problem of the protection of particularly vulnerable groups, such as children and young people in the information society, and to reflect on the measures to be taken to combat the dangers and threats to which they are subject the minorities in the digital society. The specific objectives are to recapitulate what has been done on the protection of minors in the digital world and to outline the next steps needed to strengthen it.
The methodologies were based in a theoretical and descriptive approach, through the study of the european programs about information, audiovisual and communications technologies, as well as the analysis of legislation, especially European directives and regulations, on the protection of minors. The empirical methodologies used are based on studies of children between the ages of 8 and 16 years, show that children are not only addicted to communicating through social networks, but also have very dangerous behaviors in them, putting them and the rest of the family in danger, and that about 31% of children are willing to lie online about their age. Most children end up sharing «too much personal information» without realizing that the information they share can be seen and used by dangerous people. About 66% share the name of the school they attend, 54% share the sites they visit and 22% share their addresses. Several European Commission reports outline measures taken by Member States to protect children in the context of online activities such as the European Commission’s Safer Internet Program on safer Internet use, but it is not enough as children continue to be able to access without major difficulties content that is not suitable for their age, which are illegal and harmful.
The results show that age restrictions on the Internet are ineffective against illegal or harmful content on the Web and result in the clandestine use of many online services, leading children to lie about their age to use prohibited sites, platforms and applications.
We conclude that parents and educators are not being able to keep up with the changes brought about by the children of technological innovations. It is imperative to discuss the need to invest in the education of the young, teaching them how to deal with the digital world, and their commitment to combat illegal and inappropriate content. The implementation of these measures involves the intervention of law-makers at the international and national levels, but technological means of control and filtering of information must also be used. In addition, illegal or harmful content is generally from other EU Member States or from third countries. A coordinated approach at European and then international level would make it possible to harmonize protection against this type of content.
